Ismari Nieuwenhuize-Smit

Associate Attorney

For Ismari, the practice of law requires clarity, discipline and a strong ethical foundation. As an Associate Attorney at Moloto Weiss Inc. Attorneys, Mafikeng Branch, she brings more than a decade of experience in civil litigation.

Ismari completed her LLB at North-West University’s Potchefstroom Campus, followed by an LLM in Labour Law. Her commitment to continuous professional development is reflected in a range of specialised certifications, including mediation training in civil and medical negligence matters, as well as advanced courses in legal costs and Road Accident Fund litigation.

She began her legal career in private practice, completed her articles and gained experience in collection matters and divorce litigation. In 2015, she joined the Department of Justice and Correctional Services as an Assistant State Attorney, where she represented key state institutions, including the Minister of Police and the National Director of Public Prosecutions, in civil litigation matters. She was later promoted to Senior Assistant State Attorney, where she oversaw the Medical Negligence Department within the North West Office of the State Attorney in Mahikeng.

Working closely with legal officers, medical professionals and government institutions, Ismari developed a strong interest in personal injury litigation and the strategic demands of complex civil cases.

She later returned to private practice in a consultancy role, advising on litigious matters, developing a strong correspondent practice in the High Court, and gaining further experience in collections, foreclosure proceedings and the taxation of bills of costs. During this time, she also lectured as a locum lecturer at North-West University’s Mahikeng Campus, presenting modules in civil procedure and the law of evidence.

Her current practice focuses on civil litigation, including Road Accident Fund claims and matters involving unlawful arrest and detention. Known for her direct and methodical approach, Ismari places strong emphasis on clear communication and procedural efficiency.

“Litigation can be complex and often lengthy,” she says. “My responsibility is to guide clients through that process efficiently while ensuring their case is properly presented before the court.”

Guided by a strong personal code of ethics, she believes that trust, professionalism and transparency are essential to every successful legal matter. Her aim is not only to secure effective outcomes for clients, but also to uphold the integrity of the legal process.

In addition, Ismari contributes to the profession as a member of the North West Legal Practice Council’s panel of examiners, assisting in the assessment of competency-based examinations for aspiring legal practitioners.

Outside the office, she enjoys spending time with her spouse, reading, and socialising with friends. She is also a member of the Molopo Shooting Club, where she participates in International Practical Shooting Confederation (IPSC) and accuracy-based shooting competitions.

With her extensive litigation experience, academic involvement and disciplined approach to legal practice, Ismari continues to strengthen the Moloto Weiss Inc. Attorneys team while building a practice centred on effective advocacy and client trust.
